कई बार ऐसी खबरें मिडिया में आती हैं कि गैर मजहब में शादियां होती हैं, कुछ दिनों महीनों या वर्षों तक सबकुछ ठीक चलता है और बाद में किसी न किसी कारण से तलाक की नौबत भी आती है। चुकि इस्लाम धर्म में शरिया कानून के अनुसार तलाक़ देना आसान है इसलिए लड़के पत्नी को तलाक देकर दूसरी शादी कर लेते हैं, जबकि हिन्दू समाज में यह आसान नहीं होता। कोर्ट में आपको उचित कारण प्रस्तुत करना होगा। सभी फार्मेलिटी पूरी होने के बाद भी न्यायालय दोनों को एक साथ रहने और सुलह कर लेने के मौके देता है। यदि सुलह नहीं होता तो तलाक पर मुहर लग जाती है परन्तु यदि दूसरी शादी नहीं करती तो उसको पति से गुजारा भत्ता लेने का हक होता है।

पहली बात तो यह है कि सुप्रीम कोर्ट का क्या रुख होगा, पता नहीं। दूसरी बात यह है कि शादी वैध नहीं तो लिव इन रिलेशनशिप तो वैध कर रक्खा गया है। क्या फर्क पड़ता है। हिन्दू लड़का मुस्लिम लड़की जो शायद कभी ही होता हो तो सर तन से जुदा की आवाज़ें,और हिंदू लड़की, व मुस्लिम लडका,तो अल्लाह की मेहर। वाह भाई, क्या बात है।

Does Special marriage act 1954 allows in written for police protection seeking by any party to perform their marriage,? If yes, highcourt judgment is wrong but if no, you are misleading your students through this lecture. For your information this act does not allow in writing for police protection. But such request purely depends on judges....

Secton 7 of the Special marrige Act is the only culprit , which obstructs the inter caste marriage by raising concern of families of both or either parties.
The aim of special marriage Act is to protect the intercaste couple from social ailments. This section 7 should be ammended Or ommited. It is the violation of personal liberty of the age martured boy and girl .under article 21 of The Constitution. MP HC decision is contradictory to the constitutional and fundamental rights.
If any one, in danger, on any reason/ grounds, world wide all government duty to defend him to provide protection
Bad judgement by MP High court, courts have to understand the delicate situation and provide assistance to people who are registering under Special marriage act .
On western countries the concept of marriage is almost non - existing and people get married when they become grandparents, different family concept there , so in our country courts should protect such vulnerable groups

This decision of the court is a very wrong decision because it is partiality in a way. There are different laws for Hindu boys and not for Muslim boys. If a Hindu boy marries a Muslim girl, he can do it in any way, whether she converts or not, he can do it in any way. But what if a Muslim girl marries a Hindu boy? If a Hindu girl marries a Muslim boy, she will not be allowed to do so.

सबसे पहली बात तो आजकल जो देखी जा रही है वो है अत्यधिक हिंदुवादिऔर तथाकथित सनातनी सनातनी वाला गाना जिसके पीछे का सबसे बड़ा कारण है हमारी सरकार जिसके आने के बाद ज्यादा हिंदू मुस्लिम होना चालू हुआ है और इस पर भी अगर न्यायपालिका में देखा जाए तो वहां बैठे भी ज्यादातर न्यायाधिकारीगण या तो ब्राह्मण हैं या ब्राह्मणवादी विचारधारा से ग्रसित हैं वे सनातनी वाले हैं तो उनकी व्यक्तिगत विचारधारा का असर उनके निर्णय पर जरूरी दिखता है।
अगली बात ये कि भारत का कानून चाह कर भी एकरूपता नहीं ला सकता यहां कारण है वोटबैंकिंग इसलिए पर्सनल लॉज बना बना कर हरेक जात मज़हब को खुश रखा जाता है जबकि अगर शादी या तलाक़ कानूनी तरीके से हो तो एक ही प्रोसेस से और जल्दी होनी चाहिए। फिर किसके घरवाले चाहेंगे कि उनकी लड़की और लड़का उनकी मर्जी के खिलाफ़ कहीं और शादी करे तो ये पागलपन भी गलत है कि उनके घर के लोगों को नोटिस जाता है कोर्ट से जबकि लोग कोर्ट की शरण में ही इसलिए आते हैं कि साथ रहने का मोटिव एक लाइसेंस के साथ पूरा हो वरना बात तो इतनी सी है कि एक आदमी और एक औरत जो कि एक दूसरे के प्रति आकर्षित हैं उन्हें साथ रहना है और वो सब करना है जो उन्हें कुंठित समाज और घर के लोग बिना लाइसेंस के करने पर बदचलन कहेंगे पर घर के लोग अगर सपोर्ट करते तो लोग भाग कर, कोर्ट से और बिना मान्यता वाली आर्य शादी भी क्यों करते ? इसके बाद अगर कोई जोड़ा न्यायालय से ही न्याय और पुलिस प्रोटेक्शन ना पा सके तो फिर न्यायपालिका का महत्व क्या है जो कि सामाजिक मान्यताओं के आगे कमजोर हो जाती है जबकि संविधान और नागरिकों की रक्षा सुरक्षा सर्वोपरि है। समाज और धर्म कोई नैसर्गिक नहीं है लेकिन स्वतंत्रता और सुरक्षा का अधिकार नैसर्गिक है। पुलिस प्रोटेक्शन ना देकर न्यायालय क्या यह जिम्मेदारी लेगा कि अगर जोड़े के साथ ऑनर किलिंग या मॉब लिंचिंग जैसा कुछ हुआ तो न्यायालय उसका दोषी खुदको मानेगा ?

It's a disgraceful decision given by the Honourable M.P H.Court.
It shows that the Special Marriage Act does not cover the protection provision for such a couple.
Here is an appeal by the pair but one court allows and the other court not. So it is unsocial decision in this case as well as open the door for unwanted crime by their relatives to breach such marriage. It's a biased pronouncement.

Judge is perfectly correct. He has done the correct thing by educating the ill-informed Hindu girl ( who is being mis-led).
Not only is the marriage illegitimate as per Quran, this also means that the husband will have no obligations if he chooses to divorce her later. Even if the marriage sustains, the children born out of this marriage are illegitimate in the eyes of Quran and will have no claim of inheritance in the property of the husband. Finally she will be forced to convert to Islam.
The husband is anytime eligible to marry 3 more times without any seeking of permission from this wife.

It is better convert into husband or wife s religion (mutual decission)and practice your religion. Child will be confused anyway by knowing two different ideology , if he discovers truth.

MP High Court का Judgement बिल्कुल सही है, recently SCI ने एक Judgement दिया था, यदि किसी धर्म के हिसाब से रीति रिवाज़ से शादी नही हुई तो वो शादी valid नही है जैसे सात फेरे न लिए हो। तब किसी एक को पहले धर्म परिवर्तन करना जरूरी है तभी स्पेशल marrige act की शादी कानून में मान्य है पर धर्म के हिसाब से नही।
